The Human Person as the Origin and End of the State's Activity from the Three-Dimensional Theory of Law: Philosophical - Dogmatic - Sociological

Abstract

This investigation was made with the main purpose of illustrating the process of constitutional reform to convert the article number 1 from the Republic Constitution of El Salvador in a clause that guarantees limitations to the constitutional changes that could affect principles and rights like, life and human being’s dignity.

Religious people, lawyers, and teachers were interviewed in the search of scientific knowledge about the necessity to protect the human being’s life that has not born. As principal results in the philosophic dimension (religious people), it was determined that life is valued since the conception until natural death. In the dogmatic dimension (lawyers), human being was recognized as origin and end of the activity of the state. Finally, in the sociological dimension (teachers), they got right that scientifically, since the fertilization; the woman starts to be the mother of a new human being.
