The labor referral of pregnant women is the warranty of special protection for the working women that are pregnant or in breastfeeding period, and they cannot be fired during this period.
The tutelage of the rights of the nasciturus and the newborn is the warranty that supports the Constitu tion of the Republic to recognize babies as humans since the moment they are born, raises the category of fundamental juridical value of the human dignity, and being this one inherent to the humans.
During the development of the research, it is critized the labor exclusion of the working pregnant women generated by the behavior rules of the organized so ciety. Later one, a confrontation between ethics theo ries are set which defend humans’ life in opposition to the trends of thoughts that pretend to separate moral from rights.
